Judicial activism is nothing new, and we shouldn’t be surprised that it’s still going on. But as we go through some recent examples of these activists, I want you to consider ⎯ what is an activist judge?
Is an activist judge one who places his or her oath to the Constitution above everything else an activist judge?
Some may say so, but no, they are not activists. What about a judge who places the opinions of other judges above the supreme law of the land?
Many who’ve gone through law school may see them as non-activists, but I say no. They are violating their oath, and while not full-blown activists, they are either activists or cowards.
The truly activist judge is one who places their opinions and preferences above the law and who twists and turns the law to get the outcome they desire.
It’s not just judges we have to consider. Because every time someone wants to take the wishes of a few and place them above the rights of the many, they are activist, tyrants, and antithetical to liberty and justice.
